Photo Quality

> Helipix uses only top quality cameras and lenses to bring you the very best imagery in the business. But unlike actual photographic prints, the images you see on the web have been reduced drastically to keep their storage requirements low. The following sample shows the difference between what you see in the Gallery of photos and what the actual quality really is when printed. In fact, once printed to photographic paper, the image will look even better!

Finding Your Photos

> There are two ways to search for your photos from our growing collection of images.

1. Simply drill down through the different categories.

2. Enter your keywords into the Search box such as, Sail #, Street Address, License Plate, etc. (currently off-line)

The Lightbox

> The Lightbox is YOUR collection of images. You may add up to 30 images to your Lightbox. They will be held for 30 days. If you wish to purchase an image that is in your Lightbox, click on the thumbnail to view the enlarged image. Select the items that you want to purchase and click the "Add to Cart" button.

Shopping Cart

> The Shopping Cart displays your order details. You may change the Quantity at any time by entering a new number and selecting UPDATE action. If you wish to delete an image from your order before proceeding to Checkout, simply click the Remove option to the right.

Checking out

> You will need to login to checkout your order. If you are new to the site, you will need to register and create a Username and Password. 

> We utilize the Skipjack payment gateway to facilitate secure Credit/Debit Card purchases from this site. (Your Credit Card number is not stored on our server or keep on file.)

> If you do not want to use our online ordering system, we are available to take phone orders from 9AM to 5PM Eastern Standard time every day. Our off-line credit card system accepts VISA, MasterCard, American Express, Discover and most Debit cards. 

> You can of course, always mail a check or money order along with a list of the category/image names, print sizes and quantities. (additional processing time required)

At Helipix.com, LLC, we take great care to capture high quality, vibrant and exciting pictures and sell them at reasonable prices. Marketing photographs on-line and delivering them by shipping carrier can create unusual problems. In order to control all situations we require your agreement to certain policies before sending your pictures.

1. Delivery: Helipix.com, LLC will send pictures to you (the customer) at the address you provide. The pictures will be considered delivered when the Shipping Agent (i.e. United Parcel Service, United States Postal Service, etc.) records them as delivered to the address on their electronic recording device. As the shipping agent will not ask the recipient for personal identification, you the customer contractually agree by requesting pictures from Helipix.com LLC that you will not make a claim for non-receipt of pictures, provided that our shipping agent has recorded them as delivered to your address. 

2. Returns: All Helipix sales are final. However, if your prints are delivered damaged, it is your responsibility to contact the shipper to make a claim. You must re-purchase your replacement prints from the Helipix.com website. IMPORTANT: Save all packing materials. Failure to do so can cause the shipper to deny your claim. You agree not to pursue Helipix.com with legal action. 

3. Shortages: We accurately count the pictures that we send you and accurately count those that you return. Our count of the photographs is the one that matters and is final. If you return a package to us and pictures are missing, then we will assume that you kept them and wish us to credit you only for the returns. 

4. Collections: Failure on your part to comply with the terms and conditions of this contract shall constitute a default entitling us to pursue any legal or equitable remedies including the collection of reasonable attorney’s fees and court costs incurred as a result of default. 

5. Copyright: All images remain the property of Helipix.com, LLC which has exclusive rights to the images. You are buying an individual photograph of our image and not the image itself. Photographs cannot be copied photographically or electronically for any reason. Use on websites, in Ads, Magazines, on T-Shirts, Brochures, Posters, Postcards, Business Cards, Computer Screen Savers, Brokerage Ads, Mugs, scanning the photographs or any other uses are expressly forbidden without prior written permission from Helipix.com.

COPYRIGHT NOTICE

Helipix.com, LLC expressly retains all ownership of copyright in the subject photograph(s) (the “Work”) including the exclusive right to reproduce the Work in all media, to prepare derivative works based on the Work, to distribute copies of the Work to the public by sale or other disposition and to display the Work publicly. The sale of a copy of the Work to Customer does not convey The Copyright to the Work.

Helipix.com, LLC grants Customer the right to privately display the Work in Customer’s home or business. However no license is granted to use the Work for purposes of commerce or advertisement of any product or service.

In the event Customer fails to ensure full payment for the Work to Helipix.com, LLC, Customer shall be liable for liquidated damages equal to the purchase price, interest thereon at the highest rate permitted by law or 18% per annum (whichever is lower), plus Helipix.com’s LLC actual attorney’s fees incurred at all levels including pre-litigation, litigation and appeal; and Customer shall pay all costs incurred by Helipix.com, LLC incident to collection.

In the event Customer infringes on Helipix.com’s LLC copyright in and to the Work in any manner, Customer agrees that 

(a) Helipix.com LLC shall be entitled to obtain an immediate injunction to prevent further infringement (in which event Helipix.com, LLC shall not be required to Post bond or if bond is not waiveable such bond shall not exceed $100.); 

(b) Helipix.com, LLC shall be entitled to recover the greater of it’s actual attorney’s fees at all levels and costs incurred in enforcing it rights under the U.S. Copyright Act (Title 17, U.S. Code) and under any federal or ancillary state claims for relief. Under no circumstances will Helipix.com, LLC or its principals be responsible for Customer’s
Attorney’s fees or costs unless it shall have been judicially determined that Helipix.com, LLC brought suit maliciously and in bad faith, and that there was a total absence of any justifiable issue of law or fact.

The parties agree that the sole and exclusive venue for the resolution of any and all disputes arising from this Contract or for copyright infringement shall lie in a Court of competent jurisdiction situated only in Oakland County, Michigan. The parties further agree that service of process will be deemed valid if it is affected in the manner prescribed by the law of any State in the United States, including Certified or Registered U.S. mail, Return receipt requested.

If Customer should decide return the Work or other Helipix.com, LLC photographs sent to Customer, the Customer agrees to return all such unwanted photographs immediately to Helipix.com, LLC by Federal Express, United Parcel Service, Registered U.S. Mail (insured), or similar “Traceable” carrier. Customer assumes responsibility for all lost, damaged or unreturned photographs.
